8.3.11 Money Payment Supervision Orders |
Contents
1. Description
| 1.1 | A young person ordered to pay a financial penalty by the Court may be made subject to a Money Payment Supervision Order (MPSO) under s 88 of the Magistrates Courts Acts 1980. |
| 1.2 | The purpose of the MPSO is for the young person to receive guidance and encouragement in paying the financial penalty within the time frame set by the court. |
2. Local Policy
| 2.1 | Hillingdon discourages the use of MPSO where the young person would have no other contact with the Children’s Social Care Services or the Youth Offending Service. |
| 2.2 | Where the young person is an allocated case within Children’s Social Care Services, the MPSO should be held by the allocated worker. A memo will be sent to the social worker advising them to the terms and requesting that in the event of closure, the matter be referred back to the YOS. |
| 2.3 | Where the young person is allocated within the YOS, the order will be managed by the supervising officer/ allocated worker. |
| 2.4 | Should an MPSO be made on a young person who is not currently an open case to either service, the order will be managed by the YOS, allocated by the Operational Manager for Courts and Orders. |
3. Process
| 3.1 | A young person placed on a MPSO will be written to within a week of the order being made. |
| 3.2 | The responsible officer will contact the finance office at the Youth Court on a monthly basis to clarify whether or not payments have been made. |
| 3.3 | Where payments are not being made, a reminder letter will be sent to the young person and a copy to their parent/ carer (Pro forma 2). |
| 3.4 | Should the Court contact the responsible officer regarding the non-payment of a financial penalty by a young person, it is to be advised in writing of the efforts made to encourage payment. |
